BIZFLARE ACCEPTABLE USE POLICY

Version 1.0 · Effective 10 August 2026

1. INTRODUCTION

  • This Acceptable Use Policy ("AUP") explains the permitted and prohibited uses of the BizFlare Services.
  • BizFlare is operated by:
  • KSS Companies Pty Ltd, 15 Guildford Road, Cambridge Park NSW 2747, Australia
  • In this Policy, KSS Companies Pty Ltd is referred to as "BizFlare", "we", "us" or "our".
  • The person or business using BizFlare is referred to as "Customer", "you" or "your".
  • This AUP forms part of the BizFlare Terms of Service.

2. PURPOSE

  • The purpose of this AUP is to ensure that BizFlare is used:
  • lawfully;
  • responsibly;
  • securely;
  • fairly;
  • in a manner that protects other Customers and Users; and
  • in a manner that does not compromise the security, availability or integrity of the BizFlare Services.

3. ACCEPTANCE OF THIS POLICY

  • By creating an Account or using BizFlare, you agree to comply with this AUP.
  • If you allow other Users to access your BizFlare Account, you are responsible for ensuring that those Users also comply with this AUP.
  • A violation by one of your Users may be treated as a violation by the Customer.

4. LAWFUL USE

  • You may use BizFlare only for lawful business purposes.
  • You must not use BizFlare to:
  • violate applicable laws;
  • violate regulations;
  • infringe another person's rights;
  • commit fraud;
  • facilitate unlawful activity;
  • distribute unlawful material;
  • deceive other persons; or
  • assist another person in committing an unlawful act.

5. BUSINESS USE

  • BizFlare is designed to help businesses manage activities such as:
  • invoices;
  • quotations;
  • customers;
  • products;
  • inventory;
  • suppliers;
  • purchase orders;
  • goods received;
  • expenses;
  • recurring invoices;
  • reports; and
  • related business administration.
  • Customers should use the Services for legitimate business and administrative purposes.

6. PROHIBITED ACTIVITIES

  • You must not use BizFlare to conduct or facilitate:
  • fraud;
  • scams;
  • money laundering;
  • identity theft;
  • impersonation;
  • unlawful financial activity;
  • theft;
  • unauthorised access;
  • malicious activity;
  • unlawful surveillance;
  • harassment;
  • threats;
  • distribution of malware;
  • cyberattacks;
  • phishing;
  • spam;
  • unlawful collection of Personal Information; or
  • other unlawful activities.

7. FRAUD AND MISREPRESENTATION

  • You must not use BizFlare to:
  • create false invoices;
  • create fraudulent business records;
  • impersonate another business;
  • impersonate another person;
  • provide false business information;
  • manipulate transaction records for unlawful purposes;
  • create Accounts using false identities;
  • misrepresent your relationship with another business; or
  • facilitate fraudulent transactions.
  • BizFlare may suspend or terminate Accounts where there is a reasonable basis to suspect fraud or serious misuse.

8. FALSE OR MISLEADING INFORMATION

  • You must not knowingly enter false or misleading information into BizFlare where doing so would:
  • facilitate fraud;
  • deceive another person;
  • violate applicable law;
  • create a security risk; or
  • materially misuse the Services.
  • Customers remain responsible for the accuracy of the business information they enter into BizFlare.

9. INVOICES AND BUSINESS DOCUMENTS

  • BizFlare allows Customers to create invoices, quotations, credit notes, debit notes and other business records.
  • Customers are responsible for ensuring that these documents:
  • contain accurate information;
  • comply with applicable legal requirements;
  • are used for legitimate business purposes; and
  • do not knowingly contain fraudulent or misleading information.
  • BizFlare provides software functionality but does not independently verify every invoice, quotation or business document created by a Customer.

10. TAX AND ACCOUNTING RESPONSIBILITY

  • BizFlare provides business-management and invoicing functionality.
  • Customers remain responsible for:
  • their own accounting;
  • tax obligations;
  • GST obligations;
  • financial reporting;
  • record keeping;
  • tax invoices;
  • business compliance; and
  • obtaining professional accounting or tax advice where required.
  • Using BizFlare does not remove any legal or tax obligations applicable to the Customer.

11. PERSONAL INFORMATION

  • Customers may enter Personal Information into BizFlare as part of legitimate business activities.
  • Customers must:
  • collect Personal Information lawfully;
  • use Personal Information for appropriate purposes;
  • provide required privacy notices;
  • obtain consent where required;
  • protect Personal Information; and
  • comply with applicable privacy laws.
  • Customers must not use BizFlare to unlawfully collect, disclose or misuse Personal Information.

12. SENSITIVE INFORMATION

  • Customers should not store sensitive information in BizFlare unless the relevant functionality is specifically designed to support that information and the Customer has determined that doing so is lawful and appropriate.
  • Customers should minimise unnecessary collection and storage of sensitive information.

13. CUSTOMER CONTACT INFORMATION

  • BizFlare may allow Customers to maintain information about their customers and suppliers.
  • Customers must ensure that they have appropriate authority to collect and use that information.
  • Customer contact information must not be used through BizFlare for unlawful or abusive purposes.

14. EMAIL AND COMMUNICATIONS

  • BizFlare may provide functionality for Customers to send:
  • invoices;
  • quotations;
  • payment reminders;
  • account-related communications; and
  • other business communications.
  • Customers are responsible for ensuring that their communications comply with applicable laws.
  • Customers must not use BizFlare to send:
  • unlawful spam;
  • fraudulent messages;
  • phishing messages;
  • deceptive communications;
  • malicious content; or
  • communications that unlawfully harass or threaten recipients.

15. SPAM

  • Customers must not use BizFlare to send unsolicited commercial communications in breach of applicable law.
  • Where applicable, Customers should ensure that marketing communications:
  • are sent to appropriate recipients;
  • identify the sender;
  • include required information;
  • provide required unsubscribe functionality; and
  • comply with applicable Australian spam and privacy requirements.

16. MALWARE

  • You must not upload, transmit, distribute or introduce malicious software through BizFlare.
  • Prohibited malicious software includes:
  • viruses;
  • worms;
  • ransomware;
  • spyware;
  • trojans;
  • keyloggers;
  • malicious scripts; and
  • other harmful code.

17. CYBERATTACKS

  • You must not use BizFlare to:
  • launch cyberattacks;
  • conduct denial-of-service attacks;
  • scan systems without authorisation;
  • exploit vulnerabilities;
  • gain unauthorised access;
  • distribute malicious code;
  • attack another system; or
  • facilitate cybercrime.

18. UNAUTHORISED ACCESS

  • You must not attempt to access:
  • another Customer's Account;
  • another User's Account;
  • BizFlare administrative systems;
  • databases without authorisation;
  • internal systems;
  • restricted application functions; or
  • any other system or information that you are not authorised to access.

19. ACCOUNT CREDENTIALS

  • Users must protect their Account credentials.
  • You must not:
  • share passwords;
  • share OTPs;
  • share authentication tokens;
  • allow unauthorised persons to use your Account;
  • attempt to obtain another User's credentials; or
  • use another person's credentials without authorisation.

20. ACCOUNT SECURITY

  • Customers should:
  • use strong passwords;
  • protect OTPs;
  • review User access;
  • deactivate former Users;
  • protect devices used to access BizFlare; and
  • report suspected Account compromise.
  • BizFlare provides OTP verification and User management features as part of its security controls.

21. USER MANAGEMENT

  • Customers may create and manage authorised Users.
  • Customers should:
  • provide access only to people who require it;
  • assign appropriate roles;
  • review permissions;
  • deactivate Users when they leave the organisation; and
  • promptly remove unnecessary access.
  • BizFlare supports Admin and Staff roles and allows Users to be activated or deactivated.

22. DATA SEPARATION

  • You must not attempt to access, copy, modify or disclose another Customer's information.
  • BizFlare is designed to keep each business's data separate and private.
  • Any attempt to bypass those controls is prohibited.

23. REVERSE ENGINEERING

  • Unless expressly permitted by applicable law, you must not:
  • reverse engineer BizFlare;
  • decompile the software;
  • disassemble the software;
  • attempt to obtain source code;
  • reproduce internal algorithms;
  • bypass technical protections; or
  • create unauthorised derivative versions of the Services.

24. SECURITY TESTING

  • You must not perform:
  • penetration testing;
  • vulnerability scanning;
  • automated security testing;
  • load testing;
  • stress testing; or
  • other security testing
  • against BizFlare without prior written permission.
  • If you identify a potential security vulnerability, you should report it to BizFlare.

25. SYSTEM INTERFERENCE

  • You must not intentionally interfere with:
  • BizFlare servers;
  • databases;
  • networks;
  • APIs;
  • application functionality;
  • security controls;
  • authentication systems; or
  • other infrastructure supporting the Services.

26. AUTOMATED ACCESS

  • You must not use automated tools to access BizFlare in a way that:
  • places unreasonable load on the Services;
  • bypasses security controls;
  • circumvents usage restrictions;
  • collects information without authorisation;
  • interferes with normal operation; or
  • violates this AUP.
  • Examples include unauthorised bots, crawlers, scrapers and automated scripts.

27. DATA SCRAPING

You must not scrape or systematically collect information from BizFlare unless the functionality is expressly provided for that purpose or BizFlare has provided written permission.

28. API USE

  • If BizFlare provides API functionality, API access must be used in accordance with:
  • applicable API documentation;
  • technical limits;
  • authentication requirements;
  • security requirements; and
  • applicable BizFlare agreements.
  • You must not use an API to bypass restrictions or gain unauthorised access.

29. EXCESSIVE SYSTEM USAGE

  • You must not intentionally use BizFlare in a manner that places unreasonable load on the infrastructure.
  • BizFlare may take reasonable measures to protect the availability and performance of the Services.
  • This may include:
  • rate limiting;
  • temporarily restricting access;
  • suspending specific functionality; or
  • contacting the Customer.

30. CONTENT UPLOADED BY CUSTOMERS

  • Customers remain responsible for information and content they upload or enter into BizFlare.
  • Customers must ensure that their content:
  • is lawful;
  • does not infringe third-party rights;
  • does not contain malicious code;
  • does not unlawfully disclose Personal Information; and
  • does not otherwise violate this AUP.

31. INTELLECTUAL PROPERTY

  • You must not use BizFlare to infringe another person's intellectual property rights.
  • This includes:
  • copyright;
  • trademarks;
  • patents;
  • trade secrets;
  • confidential information; and
  • other intellectual property rights.

32. COPYRIGHT INFRINGEMENT

  • You must not use BizFlare to store, distribute or transmit copyrighted material without appropriate authority.
  • BizFlare may respond to valid complaints concerning alleged copyright infringement in accordance with applicable law.

33. TRADEMARK MISUSE

  • You must not use BizFlare or third-party trademarks in a manner that:
  • suggests unauthorised endorsement;
  • creates confusion;
  • misrepresents ownership; or
  • infringes applicable trademark rights.

34. HARASSMENT AND ABUSE

  • You must not use BizFlare to facilitate:
  • harassment;
  • stalking;
  • threats;
  • intimidation;
  • abuse;
  • discriminatory conduct; or
  • other unlawful behaviour.

35. ILLEGAL GOODS OR SERVICES

You must not use BizFlare to facilitate transactions involving goods or services that are unlawful under applicable law.

36. REGULATED ACTIVITIES

  • Customers are responsible for ensuring that their use of BizFlare complies with any industry-specific laws or regulations applicable to their business.
  • BizFlare does not represent that the Services are suitable for every regulated industry or activity.

37. FINANCIAL MISUSE

  • You must not use BizFlare to:
  • create fraudulent financial records;
  • facilitate money laundering;
  • conceal unlawful transactions;
  • create false accounting records;
  • facilitate financial scams; or
  • otherwise misuse the Services for unlawful financial activity.

38. IMPERSONATION

  • You must not impersonate:
  • another Customer;
  • another User;
  • BizFlare;
  • KSS Companies Pty Ltd;
  • a Partner;
  • an accountant;
  • a financial institution; or
  • another person or organisation.

39. FALSE REPRESENTATION OF BIZFLARE

  • Customers and Users must not represent themselves as:
  • employees of BizFlare;
  • authorised representatives of BizFlare;
  • agents of BizFlare;
  • owners of BizFlare; or
  • authorised partners of BizFlare
  • unless BizFlare has expressly authorised that representation.

40. SECURITY VULNERABILITIES

  • If you discover a potential security vulnerability in BizFlare, you should notify BizFlare promptly.
  • You must not:
  • exploit the vulnerability;
  • access unrelated Customer Data;
  • publicly disclose exploitable details before BizFlare has had a reasonable opportunity to investigate; or
  • use the vulnerability for personal benefit.

41. RESPONSIBLE DISCLOSURE

  • BizFlare encourages responsible reporting of security vulnerabilities.
  • A report should include, where reasonably possible:
  • description of the issue;
  • affected functionality;
  • steps to reproduce the issue;
  • potential impact; and
  • supporting information.

42. PROHIBITED COMMERCIAL USE

  • You must not use BizFlare to provide an unauthorised service that:
  • resells BizFlare;
  • replicates BizFlare functionality;
  • competes directly with BizFlare using unauthorised access;
  • provides access to BizFlare to unrelated third parties; or
  • circumvents BizFlare Subscription Plans.

43. ACCOUNT SHARING

  • Customers must not share a single User Account among multiple individuals where individual User Accounts are available.
  • Each person should use their own authorised User Account where required by the applicable Subscription Plan.
  • This supports:
  • security;
  • accountability;
  • access management; and
  • audit trails.

44. AUDIT TRAIL

  • BizFlare may maintain records of User activity for security and accountability purposes.
  • The BizFlare platform includes an activity log and audit trail for User activity.
  • Users must not attempt to:
  • disable security logging;
  • modify audit records;
  • delete security records;
  • bypass audit mechanisms; or
  • otherwise interfere with security records.

45. MISUSE OF REFERRAL PROGRAM

  • Customers participating in the BizFlare Referral Program must comply with the BizFlare Partner & Referral Agreement and applicable referral rules.
  • You must not:
  • create fake referrals;
  • create multiple Accounts to obtain rewards;
  • manipulate referral codes;
  • misuse credit points;
  • create fraudulent transactions; or
  • otherwise manipulate the referral system.

46. CREDIT POINT MISUSE

  • BizFlare credit points must only be used according to the applicable Referral Program rules.
  • Customers must not:
  • sell credit points;
  • transfer credit points without permission;
  • attempt to convert credit points to cash;
  • manipulate the credit system; or
  • create fraudulent referrals to obtain credit points.

47. THIRD-PARTY INTEGRATIONS

  • If BizFlare provides integrations with third-party services, Customers must use those integrations in accordance with:
  • BizFlare requirements;
  • third-party terms;
  • applicable laws; and
  • security requirements.
  • Customers remain responsible for information they transfer to third-party services.

48. THIRD-PARTY SERVICES

  • BizFlare may allow Customers to connect third-party services.
  • BizFlare is not responsible for the independent operation, security or privacy practices of third-party services that are outside BizFlare's control.
  • Customers should review the applicable third-party terms and privacy policies.

49. DATA EXPORT

  • Customers must ensure that exported Customer Data is handled securely.
  • Once information is exported from BizFlare, the Customer is responsible for protecting that exported information.
  • Customers must not use exported information in violation of applicable privacy laws.

50. DATA DELETION

  • Customers should ensure that information they no longer need is appropriately removed where required.
  • Customers remain responsible for determining their own legal retention obligations.

51. PROHIBITED USE OF SYSTEM INFORMATION

  • You must not use BizFlare system information to:
  • identify security vulnerabilities for exploitation;
  • attack infrastructure;
  • gain unauthorised access;
  • reverse engineer the platform; or
  • assist another person in compromising BizFlare.

52. BUSINESS CONTINUITY AND EMERGENCY MEASURES

  • BizFlare may temporarily restrict or suspend certain functionality where necessary to:
  • protect Customer Data;
  • protect the Services;
  • prevent an attack;
  • investigate security incidents;
  • maintain system integrity; or
  • comply with legal requirements.

53. SUSPENSION FOR AUP VIOLATIONS

  • BizFlare may suspend an Account or specific functionality where it reasonably believes that:
  • this AUP has been violated;
  • the Account creates a security risk;
  • fraudulent activity has occurred;
  • unlawful activity has occurred;
  • another Customer may be affected; or
  • immediate action is necessary to protect the Services.

54. NOTICE OF SUSPENSION

  • Where reasonably practicable, BizFlare may notify the Customer before or after suspension.
  • However, immediate suspension may occur where advance notice could:
  • increase security risks;
  • allow continued misuse;
  • cause harm to another Customer;
  • interfere with an investigation; or
  • otherwise compromise the Services.

55. RESTORATION OF ACCESS

  • BizFlare may restore access after:
  • the relevant issue has been resolved;
  • appropriate security measures have been implemented;
  • required information has been provided;
  • the Customer confirms compliance; or
  • BizFlare otherwise determines that restoration is appropriate.

56. TERMINATION

Serious or repeated violations of this AUP may result in termination of the Customer's Account in accordance with the BizFlare Terms of Service.

57. REPORTING MISUSE

  • If you believe that another person is misusing BizFlare, you may report the matter to BizFlare.
  • Reports may be sent to:
  • Support: support@bizflare.com.au
  • Legal: legal@bizflare.com.au
  • Privacy: privacy@bizflare.com.au

58. INVESTIGATIONS

  • BizFlare may investigate suspected violations of this AUP.
  • Where reasonably necessary, BizFlare may:
  • review relevant system records;
  • review Account activity;
  • restrict access;
  • preserve relevant information;
  • request additional information; and
  • take appropriate corrective action.

59. COOPERATION

  • Customers must reasonably cooperate with BizFlare investigations relating to:
  • security;
  • fraud;
  • misuse;
  • unauthorised access;
  • privacy incidents; or
  • other significant violations of this AUP.

60. NO WAIVER

If BizFlare does not immediately enforce a provision of this AUP, this does not mean that BizFlare has waived its right to enforce it later.

61. CHANGES TO THIS POLICY

  • BizFlare may update this AUP from time to time to reflect:
  • changes to the Services;
  • changes in technology;
  • changes in security threats;
  • changes in applicable law;
  • changes in business practices; or
  • lessons learned from incidents.
  • Where material changes affect Customers, BizFlare will provide reasonable notice where required.

62. RELATIONSHIP WITH OTHER DOCUMENTS

  • This AUP should be read together with:
  • BizFlare Terms of Service
  • BizFlare Privacy Policy
  • BizFlare Data Processing Agreement
  • BizFlare Information Security Policy
  • BizFlare Refund & Cancellation Policy
  • BizFlare Partner & Referral Agreement
  • applicable Subscription Plan terms; and
  • other applicable BizFlare policies.

63. CONFLICT WITH TERMS OF SERVICE

  • If there is a conflict between this AUP and the BizFlare Terms of Service, the Terms of Service will generally govern unless the relevant provision specifically states otherwise.
  • Mandatory requirements under applicable law will prevail.

64. GOVERNING LAW

This AUP is governed by the laws of New South Wales, Australia, subject to any mandatory requirements under applicable law.
