BIZFLARE REFUND & CANCELLATION POLICY

Version 1.0 · Effective 10 August 2026

1. INTRODUCTION

  • This Refund & Cancellation Policy explains how subscription cancellations, subscription renewals, payments and applicable refunds are handled for the BizFlare Services.
  • BizFlare is operated by:
  • KSS Companies Pty Ltd, 15 Guildford Road, Cambridge Park NSW 2747, Australia
  • In this Policy, KSS Companies Pty Ltd is referred to as "BizFlare", "we", "us" or "our".
  • The person or business using BizFlare is referred to as "Customer", "you" or "your".
  • This Policy should be read together with the BizFlare Terms of Service and other applicable BizFlare policies.

2. SUBSCRIPTION PLANS

  • BizFlare provides subscription-based software services.
  • Depending on the plan selected, Customers may be billed:
  • monthly; or
  • annually.
  • The applicable price, features and billing frequency will be displayed at the time of purchase.

3. BILLING

  • When you subscribe to BizFlare, you agree to pay the applicable subscription fee for the selected plan.
  • The subscription fee is payable according to the billing frequency selected by you.
  • For example:
  • a monthly subscription is billed according to the monthly billing cycle; and
  • an annual subscription is billed according to the annual billing cycle.

4. SUBSCRIPTION RENEWAL

  • Unless you cancel your subscription before the next renewal date, your subscription may automatically continue for another billing period.
  • The applicable subscription amount may be charged for the next billing period in accordance with the subscription terms presented to you.

5. CANCELLING YOUR SUBSCRIPTION

  • You may cancel your BizFlare subscription through the cancellation process made available by BizFlare or by contacting BizFlare support.
  • Cancellation will prevent the subscription from renewing for the next billing period, subject to the applicable cancellation terms.

6. EFFECT OF CANCELLATION

  • When you cancel your subscription:
  • Your current subscription remains active until the end of the subscription period that you have already paid for.
  • For example, if you have a monthly subscription and cancel halfway through the month, your Account will generally remain available until the end of that paid monthly subscription period.
  • Similarly, if you have an annual subscription and cancel during the year, your Account will generally remain available until the end of the paid annual subscription period.

7. CANCELLATION DOES NOT IMMEDIATELY TERMINATE ACCESS

  • Cancelling a subscription does not normally mean that your BizFlare Account will be immediately disabled.
  • Instead:
  • the cancellation request is recorded;
  • the subscription is marked not to renew;
  • the Customer continues to have access to the applicable Services; and
  • access continues until the end of the current paid subscription period.

8. NO FURTHER RENEWAL PAYMENT AFTER CANCELLATION

  • Once a subscription has been successfully cancelled before the next renewal date, BizFlare will not charge the Customer for the next subscription period.
  • The Customer can continue using the Services until the end of the current paid subscription period.

9. ORDINARY CANCELLATION

  • If you cancel because you:
  • no longer require BizFlare;
  • have changed your business circumstances;
  • have chosen another software provider;
  • are no longer using the Services;
  • have reduced your business activities; or
  • otherwise choose to discontinue the Services
  • your current subscription will generally continue until the end of the paid subscription period.

10. SUBSCRIPTION PERIOD ALREADY PAID

  • Fees paid for a subscription period generally relate to access to the BizFlare Services during that subscription period.
  • Cancelling a subscription does not normally shorten the already-paid subscription period.
  • The Customer may continue to use the applicable Services until the subscription period expires, subject to the BizFlare Terms of Service.

11. ANNUAL SUBSCRIPTIONS

  • If you select an annual subscription, the applicable annual subscription fee is charged for the annual subscription period.
  • If you cancel an annual subscription:
  • the subscription will generally not renew for another annual period;
  • your existing annual subscription remains active until its expiry date; and
  • you may continue using the Services until that expiry date.

12. MONTHLY SUBSCRIPTIONS

  • If you select a monthly subscription, the applicable monthly subscription fee is charged for each subscription period.
  • If you cancel a monthly subscription:
  • the subscription will generally not renew for the next month; and
  • you may continue using the Services until the end of the current paid monthly period.

13. CHANGE OF MIND

  • Where permitted by applicable law, BizFlare does not generally provide refunds simply because a Customer:
  • changes its mind;
  • decides not to use the Services;
  • does not use the Services during a paid subscription period;
  • finds another software provider; or
  • no longer requires the Services.
  • This does not limit any rights that cannot legally be excluded under applicable law.

14. UNUSED TIME

  • If a Customer stops using BizFlare before the end of a paid subscription period, the Customer may continue to access the applicable Services until the subscription period ends.
  • Simply choosing not to use the Services does not normally shorten the subscription period.

15. REFUNDS REQUIRED BY LAW

  • Nothing in this Policy is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under applicable law.
  • Where the Australian Consumer Law or another applicable law gives a Customer a right to a refund, cancellation, compensation or another remedy, BizFlare will provide the applicable remedy in accordance with the law.
  • Australian Consumer Law consumer guarantees can apply to services, including certain business purchases. In circumstances involving a major failure, a Customer may have a right to cancel the service contract and receive a refund for the unused portion or compensation for reduced value. (ACCC)

16. SERVICE PROBLEMS

  • If you experience a significant problem with the BizFlare Services, please contact BizFlare before initiating a payment dispute or chargeback where reasonably possible.
  • We will investigate the issue and determine the appropriate response.
  • Depending on the circumstances, BizFlare may:
  • investigate the issue;
  • correct a technical problem;
  • restore affected functionality;
  • provide reasonable assistance;
  • provide another appropriate remedy; or
  • provide a refund or other remedy where required by law.

17. MAJOR SERVICE FAILURE

  • Where a service failure constitutes a major failure under applicable Australian Consumer Law, Customers may have rights that cannot be excluded by this Policy.
  • These rights may include cancellation of the service and a refund for the unused portion of the service or compensation for reduced value, depending on the circumstances. (ACCC)

18. MINOR SERVICE PROBLEMS

  • Where a problem with the Service does not amount to a major failure, BizFlare may first seek to rectify the issue within a reasonable time.
  • If the problem cannot be appropriately resolved within a reasonable time, the Customer may have additional rights under applicable law. (ACCC)

19. TECHNICAL INTERRUPTIONS

  • Temporary interruptions to the Services do not automatically result in a refund.
  • BizFlare may experience interruptions caused by:
  • scheduled maintenance;
  • emergency maintenance;
  • infrastructure problems;
  • network problems;
  • security incidents;
  • third-party service outages;
  • circumstances beyond BizFlare's reasonable control; or
  • other technical issues.
  • BizFlare will take reasonable steps to restore affected Services.

20. FREE TRIALS AND PROMOTIONAL PERIODS

  • If BizFlare offers a free trial, discounted period or promotional subscription, the specific terms of that offer will apply.
  • Promotional offers may have:
  • eligibility requirements;
  • limited durations;
  • specific Subscription Plans;
  • special cancellation requirements; or
  • other conditions.
  • The applicable promotional terms will be communicated at the time the offer is made.

21. PROMOTIONAL PRICING

  • If a Customer subscribes using promotional pricing, cancellation will generally prevent the next renewal but will not normally create a refund for the current paid subscription period.
  • Any specific promotional terms presented at the time of purchase will apply.

22. PLAN CHANGES

  • Customers may be able to change their BizFlare Subscription Plan depending on the functionality provided by BizFlare.
  • The financial effect of a plan change will be communicated at the time of the change.
  • Where a plan change results in an additional charge, the applicable amount will be displayed before confirmation.

23. UPGRADE

  • If a Customer upgrades to a higher-priced plan, BizFlare may apply the new pricing according to the applicable billing process.
  • Any applicable credit, adjustment or additional charge will be communicated through the subscription process.

24. DOWNGRADE

  • If a Customer downgrades to a lower-priced plan, the downgrade may take effect at the beginning of the next subscription period unless otherwise stated.
  • Certain features or functionality may no longer be available after the downgrade.
  • Customers should review their Account and data before downgrading.

25. DATA BEFORE CANCELLATION

  • Customers should export important information before their subscription ends.
  • This may include:
  • invoices;
  • quotations;
  • customer information;
  • product information;
  • inventory information;
  • supplier information;
  • reports; and
  • other business records.

26. DATA EXPORT AFTER CANCELLATION

  • BizFlare may provide a limited period after cancellation during which Customer Data can be accessed or exported.
  • The standard BizFlare data-export period is intended to be:
  • 60 days following cancellation or termination.
  • This period is subject to technical availability and the applicable BizFlare Terms of Service.

27. ACCOUNT CLOSURE

After the applicable post-cancellation period has expired, BizFlare may close the Account and delete or de-identify Customer Data in accordance with its data-retention practices and applicable legal requirements.

28. CHARGEBACKS

  • Customers should contact BizFlare first where there is a billing issue or dispute.
  • A Customer should not initiate an improper chargeback where the subscription charge was validly authorised.
  • BizFlare may investigate chargebacks and provide relevant transaction information to the applicable payment provider.

29. DUPLICATE CHARGES

  • If a Customer believes that it has been charged more than once for the same subscription period, the Customer should contact BizFlare.
  • BizFlare will investigate the transaction and, where a genuine duplicate charge is identified, take appropriate corrective action.

30. INCORRECT BILLING

  • If you believe that your subscription has been incorrectly billed, contact:
  • support@bizflare.com.au
  • Please provide:
  • Account email address;
  • invoice or transaction details;
  • date of charge; and
  • description of the issue.
  • BizFlare may request additional information to investigate the matter.

31. FAILED PAYMENTS

  • If a subscription payment fails, BizFlare may:
  • notify the Customer;
  • attempt to process the payment again;
  • restrict certain functionality;
  • suspend the Account; or
  • take other reasonable steps in accordance with the Terms of Service.
  • Customers should ensure that their payment information remains current.

32. OVERDUE ACCOUNTS

  • Where a subscription remains unpaid, BizFlare may restrict access to the Services until the outstanding amount is resolved.
  • BizFlare may provide reasonable notice before restricting access where appropriate.

33. FRAUDULENT TRANSACTIONS

  • BizFlare may investigate transactions that it reasonably suspects are:
  • fraudulent;
  • unauthorised;
  • associated with stolen payment information;
  • associated with Account compromise; or
  • otherwise suspicious.
  • BizFlare may suspend an Account while investigating a suspected fraudulent transaction.

34. CANCELLATION BY BIZFLARE

  • BizFlare may suspend or terminate an Account in accordance with the BizFlare Terms of Service where:
  • the Customer materially breaches the Terms;
  • the Customer engages in prohibited activity;
  • fraud is suspected;
  • the Customer creates a security risk;
  • payment obligations remain unpaid; or
  • termination is otherwise permitted under the Terms of Service.

35. EFFECT OF TERMINATION FOR BREACH

  • Where an Account is terminated because of a serious or material breach by the Customer, access to the Services may be suspended or terminated immediately.
  • Any refund or other remedy will be determined in accordance with the applicable Terms of Service and applicable law.

36. EFFECT OF VOLUNTARY CANCELLATION

  • Where a Customer voluntarily cancels a subscription:
  • the subscription will generally remain active until the end of the current paid subscription period;
  • the subscription will not renew for the following period;
  • no further subscription charge will be made after successful cancellation; and
  • Customer Data will be handled according to the applicable data-retention and deletion provisions.

37. CONTACTING BIZFLARE ABOUT CANCELLATION

  • Customers may contact:
  • Support: support@bizflare.com.au
  • for assistance with subscription cancellation.
  • Customers should retain confirmation of cancellation for their records.

38. CANCELLATION CONFIRMATION

  • Where technically available, BizFlare may provide confirmation that a subscription cancellation has been successfully processed.
  • Customers should check their Account status after submitting a cancellation request.

39. CANCELLATION DATE

  • The effective cancellation date will generally be the date on which the cancellation is successfully processed.
  • However, cancellation normally prevents the next renewal rather than immediately ending the current paid subscription period.

40. AUTO-RENEWAL TRANSPARENCY

  • Before or at the time of subscription, BizFlare will provide information about:
  • subscription price;
  • billing frequency;
  • renewal arrangements;
  • cancellation process; and
  • other material subscription terms.
  • Customers should review these details before completing a purchase.
  • This is particularly important because Australian regulators have identified cancellation and automatic-renewal terms as an area of consumer-protection attention. (ACCC)

41. NO AUTOMATIC WITHDRAWAL AFTER SUCCESSFUL CANCELLATION

  • Once a Customer has successfully cancelled the subscription before the next renewal date:
  • BizFlare will not charge the Customer for the subsequent subscription period.
  • The Customer will retain access until the end of the already-paid subscription period.

42. REFUND PROCESS

  • Where a refund is required or approved, BizFlare will process the refund using the applicable payment method or another appropriate method.
  • Processing time may depend on:
  • payment provider;
  • bank;
  • card issuer;
  • transaction type; and
  • other factors outside BizFlare's direct control.

43. REFUND TIMING

  • Where BizFlare agrees or is required to provide a refund, the refund will generally be processed within a reasonable period after the refund decision has been made.
  • The time taken for the amount to appear in the Customer's account may depend on the relevant financial institution or payment provider.

44. PARTIAL REFUNDS

  • Where a partial refund is required or agreed, the amount will be determined based on:
  • the applicable legal requirements;
  • the nature of the service issue;
  • the unused portion of the Service where relevant;
  • the amount paid; and
  • other relevant circumstances.

45. TAXES AND GST

Where applicable, refunds will take into account the GST or other tax treatment associated with the original transaction.

46. REFERRAL CREDIT POINTS

  • Cancellation of a BizFlare subscription may affect the Customer's ability to use BizFlare credit points.
  • Credit points are subject to the applicable Referral Program terms.
  • Credit points are not automatically convertible into cash or refundable amounts.

47. PARTNER COMMISSIONS

  • Cancellation of a Customer subscription may affect commissions associated with a referral.
  • The treatment of commissions is governed by the BizFlare Partner & Referral Agreement and applicable Partner Program terms.

48. NO WAIVER OF LEGAL RIGHTS

  • Nothing in this Policy is intended to:
  • exclude consumer guarantees;
  • restrict a legal right to a refund;
  • restrict a legal right to cancel a service;
  • exclude compensation rights that cannot legally be excluded; or
  • otherwise limit rights that cannot legally be excluded under applicable law.
  • Australian Consumer Law rights apply automatically in circumstances where the law provides them and cannot be removed simply by a business's refund policy. (ACCC)

49. POLICY CHANGES

  • BizFlare may update this Refund & Cancellation Policy from time to time.
  • Changes may be made to reflect:
  • changes in subscription plans;
  • changes in billing systems;
  • changes in applicable law;
  • changes in payment providers;
  • changes to cancellation functionality; or
  • improvements to BizFlare's processes.

50. RELATIONSHIP WITH OTHER DOCUMENTS

  • This Policy should be read together with:
  • BizFlare Terms of Service
  • BizFlare Privacy Policy
  • BizFlare Data Processing Agreement
  • BizFlare Information Security Policy
  • BizFlare Acceptable Use Policy
  • BizFlare Partner & Referral Agreement
  • applicable Subscription Plan terms.
  • If there is a conflict between this Policy and mandatory rights under applicable law, the applicable law will prevail.

51. GOVERNING LAW

This Policy is governed by the laws of New South Wales, Australia, subject to any mandatory requirements under applicable law.
