BIZFLARE PRIVACY POLICY

1. INTRODUCTION

  • KSS Companies Pty Ltd, trading as BizFlare, respects your privacy and is committed to protecting Personal Information.
  • This Privacy Policy explains how BizFlare collects, uses, stores, protects and handles Personal Information when you:

  • create a BizFlare Account;
  • use the BizFlare Services;
  • communicate with BizFlare;
  • contact our support team;
  • participate in the BizFlare referral program; or

  • Partners and Certified Business Partners;
  • people who contact BizFlare; and
  • other individuals whose Personal Information BizFlare collects in connection with the Services.

3. WHAT IS PERSONAL INFORMATION?

  • For the purposes of this Policy, Personal Information generally means information or an opinion about an identified individual, or an individual who can reasonably be identified.
  • Depending on your relationship with BizFlare, this may include information such as:

  • email address;
  • telephone number;
  • mobile number;
  • business address;
  • postal address;
  • Account information;
  • User information;
  • business information;
  • ABN or GST information where associated with an individual;
  • transaction-related information;
  • support communications; and
  • information you provide to us.

4. INFORMATION STORED THROUGH BIZFLARE

  • When a Customer uses BizFlare, the Customer may enter information about its own business and other individuals.
  • This may include:
  • customer names;
  • customer contact details;
  • customer addresses;
  • customer ABN/GST information;
  • invoices;
  • quotations;
  • credit notes;
  • debit notes;
  • payment records;
  • products;
  • inventory;
  • supplier information;
  • purchase orders;
  • goods received information;
  • supplier payment information;
  • User information;
  • activity records; and
  • other business information.
  • The BizFlare feature documentation confirms that the platform supports customer contact information, invoices, payment records, products, inventory, supplier information, User management and activity logging.

5. INFORMATION WE COLLECT DIRECTLY FROM YOU

  • We may collect Personal Information when you:
  • create a BizFlare Account;
  • subscribe to a BizFlare plan;
  • contact us;
  • request support;
  • communicate with our team;
  • participate in a referral program;
  • submit an enquiry;
  • provide feedback;
  • attend an event or interact with BizFlare representatives; or
  • otherwise voluntarily provide information to us.

6. ACCOUNT INFORMATION

  • When you create or manage a BizFlare Account, we may collect information such as:
  • name;
  • email address;
  • mobile number;
  • business name;
  • business address;
  • ABN;
  • GST information;
  • Account details;
  • Subscription information;
  • User role; and
  • other information necessary to administer your Account.

7. USER INFORMATION

  • Customers may invite team members to use BizFlare.
  • The Customer may provide information about those Users, including:
  • name;
  • email address;
  • User role;
  • Account status;
  • login information;
  • activity information; and
  • other information required to administer User access.
  • BizFlare supports Admin and Staff roles and allows Users to be activated or deactivated.

8. CUSTOMER DATA

  • Customers may enter Personal Information relating to their own customers, suppliers, employees, contractors and business contacts.
  • In these circumstances, the Customer is generally responsible for determining:
  • why the information is collected;
  • what information is collected;
  • whether collection is lawful;
  • how the information is used; and
  • how long the information should be retained.
  • BizFlare processes this information as reasonably necessary to provide the Services.

9. INFORMATION ABOUT YOUR CUSTOMERS

  • BizFlare allows Customers to maintain information about their customers, including:
  • names;
  • contact details;
  • addresses;
  • ABN/GST information;
  • invoice history;
  • payment information recorded by the Customer;
  • customer statements;
  • pricing information; and
  • other business information entered by the Customer.
  • The Customer is responsible for ensuring that it has appropriate authority to collect and use this information.

10. INFORMATION ABOUT SUPPLIERS

  • Where Customers use BizFlare's supplier-management functionality, they may enter information about suppliers, including:
  • supplier names;
  • contact details;
  • addresses;
  • pricing information;
  • purchase orders;
  • goods received information;
  • supplier payments;
  • supplier returns; and
  • other supplier-related business information.

11. INFORMATION ABOUT PRODUCTS AND INVENTORY

  • BizFlare may store information relating to:
  • products;
  • product names;
  • descriptions;
  • pricing;
  • categories;
  • product images;
  • product variants;
  • stock quantities;
  • stock movements;
  • stock takes;
  • stock valuation;
  • supplier information; and
  • other inventory information.
  • This information is generally business information rather than Personal Information, but it may become Personal Information where it relates to an identifiable individual.

12. PAYMENT INFORMATION

  • BizFlare may process information relating to payments recorded against invoices.
  • Depending on the functionality used, this may include:
  • payment amount;
  • payment date;
  • payment method;
  • invoice information;
  • payment status; and
  • related transaction information.
  • Customers are responsible for ensuring that payment information they enter into BizFlare is accurate and handled appropriately.

13. ONLINE PAYMENT INFORMATION

  • Where BizFlare provides online payment functionality, payment transactions may involve third-party payment service providers.
  • Where a third-party payment provider is used, the provider may collect and process information according to its own privacy policy and terms.
  • BizFlare will not intentionally collect payment-card information where the relevant payment functionality is handled directly by an applicable third-party payment provider.
  • The exact payment architecture may vary as BizFlare's Services develop.

14. INFORMATION WE COLLECT AUTOMATICALLY

  • When you use the BizFlare website or Services, we may automatically collect certain technical information, which may include:
  • IP address;
  • browser type;
  • operating system;
  • device information;
  • login information;
  • date and time of access;
  • pages or features accessed;
  • system events;
  • error information;
  • security information; and
  • other technical information required to operate and secure the Services.

15. LOGS AND AUDIT INFORMATION

  • BizFlare may maintain:
  • login records;
  • User activity records;
  • security logs;
  • application logs;
  • error logs;
  • system events;
  • audit records; and
  • other technical information.
  • These records may be used to:
  • maintain security;
  • investigate incidents;
  • troubleshoot problems;
  • prevent fraud;
  • maintain accountability;
  • improve reliability; and
  • operate the Services.
  • BizFlare's feature documentation specifically includes a built-in activity log and audit trail of User activity.

16. HOW WE USE PERSONAL INFORMATION

  • BizFlare may use Personal Information to:
  • provide the Services;
  • create and manage Accounts;
  • process subscriptions;
  • provide customer support;
  • communicate with Customers;
  • manage Users;
  • process referrals;
  • manage Partner Accounts;
  • maintain security;
  • prevent fraud;
  • troubleshoot technical problems;
  • maintain and improve the Services;
  • send service-related communications;
  • manage billing;
  • comply with legal obligations; and
  • perform other purposes reasonably necessary to operate BizFlare.

17. SERVICE COMMUNICATIONS

  • We may use Personal Information to send communications relating to the Services.
  • These may include:
  • Account notifications;
  • security alerts;
  • password or OTP-related messages;
  • billing information;
  • subscription notifications;
  • service announcements;
  • support communications;
  • maintenance notifications; and
  • other operational communications.
  • These communications are part of providing the Services and may continue even if you have opted out of promotional communications.

18. MARKETING COMMUNICATIONS

  • Where permitted by applicable law, BizFlare may send marketing communications about:
  • BizFlare products;
  • new features;
  • promotions;
  • special offers;
  • events;
  • educational content; and
  • other BizFlare-related information.
  • You may opt out of marketing communications using the unsubscribe mechanism included in the relevant communication or by contacting us.

19. LEADS AND PROSPECTIVE CUSTOMERS

  • BizFlare may collect information about prospective Customers through:
  • website enquiries;
  • forms;
  • events;
  • referrals;
  • direct enquiries;
  • marketing activities;
  • business communications; and
  • other legitimate business-development activities.
  • This information may include:
  • name;
  • business name;
  • email;
  • telephone number;
  • business information;
  • enquiry details; and
  • communication history.

20. REFERRAL PROGRAM

  • BizFlare operates a referral program that may allow Customers and Certified Business Partners to refer new Customers.
  • We may collect information relating to:
  • referral codes;
  • referral links;
  • referral source;
  • referred Customer;
  • referral status;
  • commission information;
  • credit points;
  • Partner information; and
  • payment information required to process eligible commissions.

21. CERTIFIED BUSINESS PARTNERS

  • Certified Business Partners may have access to a Partner Dashboard.
  • The Dashboard may contain information such as:
  • referral code;
  • referral history;
  • referred Customer status;
  • commission information;
  • pending commissions;
  • paid commissions; and
  • other information required to administer the Program.
  • Partners are required to handle information in accordance with the BizFlare Partner & Referral Agreement.

22. CREDIT POINTS

  • BizFlare may provide Customers with credit points for qualifying referrals.
  • For example, BizFlare may award:
  • 20 BizFlare credit points for each qualifying referral.
  • Credit points may be used to purchase eligible BizFlare products or services according to the applicable Referral Program terms.
  • BizFlare may maintain records of:
  • credit points earned;
  • credit points used;
  • available balance; and
  • referral activity.

23. HOW WE USE CUSTOMER DATA

  • Where a Customer enters Personal Information about its own customers, suppliers or other individuals into BizFlare, we may use that information only as reasonably necessary to:
  • provide the Services;
  • store the information;
  • process invoices;
  • manage customer records;
  • manage inventory;
  • manage suppliers;
  • generate reports;
  • send communications requested by the Customer;
  • maintain security;
  • provide support;
  • troubleshoot the Services; and
  • comply with applicable law.

24. AUSTRALIAN DATA STORAGE

  • For the Australian BizFlare service:
  • BizFlare stores Customer Data and Personal Information on servers located in Australia.
  • BizFlare's Australian service is designed around Australian data storage.
  • Customer Data may include:
  • customer information;
  • invoices;
  • quotations;
  • products;
  • inventory;
  • supplier information;
  • User information;
  • payment-related records; and
  • other business information entered into the platform.

25. DATA SECURITY

  • BizFlare takes reasonable steps to protect Personal Information against:
  • unauthorised access;
  • unauthorised disclosure;
  • loss;
  • misuse;
  • alteration;
  • destruction; and
  • other reasonably foreseeable security risks.
  • Security measures may include:
  • OTP authentication;
  • bot protection;
  • User access controls;
  • role-based permissions;
  • activity logging;
  • audit trails;
  • database security;
  • secure communications;
  • backups; and
  • other technical and organisational measures.
  • BizFlare's documented feature set includes OTP-protected login, bot protection, separate Customer data environments and audit trails.

26. USER ACCESS AND PERMISSIONS

  • BizFlare provides Customers with User-management functionality.
  • Customers may:
  • invite team members;
  • assign roles;
  • activate Users;
  • deactivate Users; and
  • manage access.
  • Customers are responsible for ensuring that Users only receive access appropriate to their responsibilities.

27. DATA SEPARATION

  • BizFlare is designed to keep each Customer's business data separate from other Customers.
  • Customers should not be able to access another Customer's information through the normal operation of the Services.

28. WHO WE MAY DISCLOSE PERSONAL INFORMATION TO

  • BizFlare may disclose Personal Information where reasonably necessary to:
  • provide the Services;
  • process payments;
  • provide technical infrastructure;
  • provide customer support;
  • maintain security;
  • prevent fraud;
  • provide email or communication services;
  • provide other services necessary to operate BizFlare;
  • comply with legal obligations; or
  • protect the rights, property or safety of BizFlare, Customers or other persons.

29. SERVICE PROVIDERS

  • BizFlare may use third-party service providers to support its operations.
  • These providers may assist with:
  • hosting;
  • infrastructure;
  • storage;
  • backups;
  • email delivery;
  • security;
  • monitoring;
  • communications;
  • customer support;
  • payment processing;
  • analytics; and
  • other operational services.
  • BizFlare will take reasonable steps to ensure that relevant service providers maintain appropriate security and confidentiality arrangements.

30. LEGAL DISCLOSURES

  • BizFlare may disclose Personal Information where reasonably necessary to:
  • comply with applicable law;
  • comply with a court order;
  • respond to a lawful regulatory request;
  • prevent fraud;
  • investigate suspected unlawful activity;
  • protect the security of the Services; or
  • protect the rights, property or safety of BizFlare or others.
  • Where legally permitted, BizFlare may notify the affected Customer before making a required disclosure.

31. DATA RETENTION

  • BizFlare may retain Personal Information for as long as reasonably necessary for:
  • providing the Services;
  • maintaining Accounts;
  • maintaining business records;
  • security;
  • fraud prevention;
  • dispute resolution;
  • legal compliance; and
  • legitimate business purposes.
  • Different information may have different retention periods.

32. CUSTOMER DATA AFTER CANCELLATION

  • Following cancellation or termination of a subscription, Customer Data may remain available for a limited period in accordance with the BizFlare Terms of Service and applicable data-retention procedures.
  • BizFlare's proposed standard Customer Data export period is 60 days following cancellation or termination, subject to technical availability and the applicable terms.
  • Customers should export important information before their Account is permanently closed.

33. DATA DELETION

  • After the applicable retention and export period, Customer Data may be:
  • securely deleted;
  • destroyed; or
  • de-identified
  • subject to:
  • legal requirements;
  • security requirements;
  • dispute resolution;
  • backup retention; and
  • other legitimate business requirements.

34. BACKUPS

  • BizFlare may maintain backups for:
  • business continuity;
  • disaster recovery;
  • system restoration;
  • security; and
  • operational purposes.
  • Backup copies may remain for a limited period after information is removed from active systems.

35. COOKIES AND SIMILAR TECHNOLOGIES

  • BizFlare may use cookies and similar technologies to:
  • operate the website;
  • maintain sessions;
  • remember preferences;
  • understand website usage;
  • improve the Services;
  • maintain security; and
  • support marketing or analytics where applicable.
  • The types of cookies used may change as the BizFlare website and Services develop.

36. ANALYTICS

  • BizFlare may use analytics technologies to understand:
  • website usage;
  • product usage;
  • performance;
  • traffic;
  • feature engagement; and
  • marketing effectiveness.
  • Where third-party analytics services are used, those providers may process information according to their own privacy policies and applicable contractual arrangements.

  • BizFlare may use marketing technologies to support:
  • advertising;
  • campaign measurement;

  • conversion measurement;

  • Where required, BizFlare will provide appropriate choices or controls relating to marketing technologies.

  • cookies;
  • certain promotional communications;
  • access to Personal Information; and
  • correction of Personal Information.
  • Some communications, such as security or Account-related communications, are necessary to provide the Services and may not be optional.

  • You may request access to Personal Information that BizFlare holds about you.

40. CORRECTION OF PERSONAL INFORMATION

  • If you believe that Personal Information BizFlare holds about you is inaccurate or incomplete, you may request that it be corrected.

  • Where appropriate, BizFlare will take reasonable steps to correct inaccurate information.

41. REQUESTS RELATING TO CUSTOMER DATA

  • Where Personal Information has been entered into BizFlare by a Customer about that Customer's own customer, supplier, employee or other individual, the Customer may generally be the appropriate party to respond to the individual's request.
  • BizFlare may assist the Customer where reasonably necessary and technically possible.

42. PRIVACY COMPLAINTS

  • If you believe BizFlare has handled your Personal Information incorrectly, you may make a privacy complaint.

43. HOW WE HANDLE PRIVACY COMPLAINTS

  • seek additional information where required;
  • take reasonable steps to resolve the matter; and
  • communicate the outcome where appropriate.
  • We aim to handle privacy complaints within a reasonable period.

44. AUSTRALIAN PRIVACY REGULATOR

  • If you are not satisfied with how BizFlare has handled your privacy complaint, you may be able to contact the Office of the Australian Information Commissioner (OAIC).
  • The OAIC provides information about privacy rights and privacy complaints in Australia.

45. CHILDREN'S INFORMATION

  • BizFlare is a business software platform and is not intended to be used as a service directed primarily at children.
  • Customers should not knowingly use BizFlare to collect children's Personal Information unless they have a lawful and appropriate business reason and comply with applicable privacy requirements.

46. INTERNATIONAL DATA TRANSFERS

  • BizFlare's Australian service is designed around Australian storage of Customer Data and Personal Information.
  • Where BizFlare uses a third-party service that involves international processing or transfer of Personal Information, BizFlare will take reasonable steps to address applicable privacy requirements.

47. DE-IDENTIFIED AND AGGREGATED INFORMATION

  • BizFlare may use aggregated or de-identified information where permitted by law.
  • This information may be used for:
  • service improvement;
  • product development;
  • statistical analysis;
  • security analysis;
  • performance analysis;
  • business planning; and
  • reporting.
  • BizFlare will take reasonable steps to ensure that information described as de-identified cannot reasonably be used to identify an individual.

48. BUSINESS TRANSFERS

  • If BizFlare is involved in a merger, acquisition, restructuring, sale of assets or similar transaction, Personal Information may be transferred as part of the relevant business transaction, subject to applicable law.
  • BizFlare will take reasonable steps to protect Personal Information during such transactions.

49. SECURITY INCIDENTS

  • If BizFlare becomes aware of a security incident that may affect Personal Information, BizFlare will take reasonable steps to:
  • identify the incident;
  • contain it;
  • investigate it;
  • reduce further risk;
  • restore affected systems where appropriate; and
  • determine whether notification is required under applicable law.
  • Where notification is required, BizFlare will take appropriate steps in accordance with applicable law.

50. YOUR RESPONSIBILITIES

  • When using BizFlare, you are responsible for:
  • protecting your Account;
  • protecting your passwords and OTPs;
  • managing Users appropriately;
  • ensuring that information you provide is accurate;
  • ensuring that you have appropriate authority to provide Personal Information to BizFlare;
  • complying with applicable privacy laws; and
  • protecting information exported from BizFlare.

51. THIRD-PARTY WEBSITES

  • The BizFlare website or Services may contain links to third-party websites or services.
  • BizFlare is not responsible for the privacy practices of third-party websites that it does not control.
  • You should review the privacy policies of those third parties before providing them with Personal Information.

52. THIRD-PARTY INTEGRATIONS

  • Where BizFlare provides integrations with third-party services, information may be exchanged between BizFlare and the relevant service according to the functionality enabled by the Customer.
  • Customers should review the relevant third-party privacy policy and terms.

53. SECURITY OF YOUR ACCOUNT

  • You are responsible for keeping your Account credentials secure.
  • You should immediately notify BizFlare if you believe:
  • your password has been compromised;
  • your OTP has been compromised;
  • your Account has been accessed without authorisation; or
  • another security incident has occurred.

54. CHANGES TO THIS PRIVACY POLICY

  • BizFlare may update this Privacy Policy from time to time.
  • Changes may be required because of:
  • changes to the Services;
  • changes in technology;
  • changes in privacy law;
  • changes in business practices;
  • new features;
  • changes to third-party services; or
  • improvements to our privacy practices.
  • The updated version will be published on the BizFlare website.
  • Where appropriate, we may also notify Customers of material changes.

55. EFFECTIVE DATE OF CHANGES

  • Unless otherwise stated, changes to this Privacy Policy will take effect when the updated Policy is published.
  • The Last Updated date at the beginning of this Policy will indicate the current version.

56. GOVERNING LAW

This Privacy Policy is governed by the laws of New South Wales, Australia, subject to any mandatory rights or requirements under applicable law.
